The following is the transcription of the Last Will and Testament of Ezra Comfort dated 14 April, 1812.

 

Will of Ezra Comfort

Be it Remembered that I Ezra Comfort of Whitemarsh Township in the County of Montgomery & State of Pennsylvania being considerably advanced in years But of sound and disposing mind memory and understanding do think proper to dispose of the world by property that divine Providence has blessed me with in manner and form following. Item I give to my dear wife the use possession and benefit of the house Celler and spring house in as full & in the same manner that I have reserved them for her and my self in the Deed, by me made to my son Ezra being the house I now live in; with all the furniture in it and it my will that my son, Ezra Comfort shall deliver her sufficient firewood but suiteable for her use at the door and also a horse and chair in order for her use when ever she should have occasion thereof and he shall also provid and furnish her with every necessary of living agreable to her wish to live comfortable and to pay her ten Pounds per annum so long as she shall remain my widow But if at any time she should see cause to enter into marriage it is my will that from that time the privileges in the house and the use of the horse and chair shall cease. Item I give and bequeath to my Daughter Elizabeth White the sum of one hundred Pouns to be paid her within six months after my decease Item I give and bequeath to my Daughter Mercy Paxton the sum of one hundred

Pounds to be paid her within one year after the legacy last above mentioned with Lawful Interest – Item I give and bequeath to my Daughter Grace Gillingham the sum of one hundred pounds to be paid in one year after the legacy last above mentioned with interest for the same annually. Item I give and bequeath to my son John Comfort the sum of on hundred Pounds to be paid in one year after the Legacy last above mentioned with interest for the same annually from within six months after my decease Item I give and bequeath to my Daughter Alice Roberts the sum of one hundred Pounds to be paid in one year after the legacy last above mentioned with interest from the same time annually – And further it is my will that if any of my daughters should not live to receive the Legacy in this will bequeathed to them or either of them; and also die without Issue I will and direct such Daughter or Daughters share or shares to be equally divided between my surviving Daughters or their Issue Item I will and bequeath unto my dear wife Alice the further sum of twenty Pounds to be paid her yearly by my son Ezra but so that the first payment shall not be made until one year after the payment of the Legacy to my youngest Daughter but if she should change her situation by marriage in that case the said Legacy to cease and become paid and if my dear wife should choose to remove from the dwelling house that I herein before have devised to her (she remaining single) then my will is that my son Ezra shall also pay her the further sum of thirty Pounds in Lieu of her privilege in and about the dwelling provision and firewood Item I will and bequeath unto my son Ezra Comfort all the residue of my Estate of whatsoever king to him and his heirs And Lastly I do hereby Nominate constitute and appoint my dear wife and my son Ezra Comfort Executors to this my last will and Testament and I do hereby revoke ???? and make void all former will & wills by me heretofore made satifying this only to be my Last will and Testament In Witness whereof I have hereunto set my hand and seal the fourteenth day of the fourth month in the year of our Lord one thousand eight hundred and twelve ??? Signed sealed and declared by the Testator to be his Last will and we at his request and in his presence he be set our name as witnesses Job Roberts Jonathan Cleaver

Personally came before me G Wach Esqr Register for the Probate of will and granting Letters of administration in and for the County aforesaid Job Roberts & Jonathan Cleaver witnesses to the foregoing will of Ezra Comfort Decd and upon their solemn affirmations did depose and say they were present did see and hear the Testator sign seal publish pronounce and declare the foregoing instrument of writing as and for his las will and Testament and at the time of so doing he was of perfect and sound mind memory and understanding to the best of their Knowledge observation and believe and further that they signed the same in his presence and at his request and further they say not. Be it Remembered that on the 26th of January AD 1820 the foregoing will of

Ezra Comfort Decd was proven in due form of Law and Letters Testamentary granted to Ezra Comfort Executor in the Testament named (Alice Comfort having renounced her executorship) he having first affirmed according to law well and truly to execute the same and Render an account according to Law, given under my hand hand and seal and Registered as above dated.
